These Digital Goods and SaaS Terms (“Terms”) govern the use, purchase, delivery, and access of:

~ XtremeGrow.com digital products, websites, and hosting (Digital Goods)
~ HelloVid interactive video widget subscriptions (SaaS)

These services are operated by The Mustard Seed Group, LLC, based in Midlothian, Virginia, under separate service offerings:

XtremeGrow → Delivers digital website systems
HelloVid → Provides paid subscription SaaS video tools

By purchasing, accessing, or using any products or services from either entity, you agree to these Terms.

1. Digital Goods Definition (XtremeGrow)

Digital Goods include all non-tangible, electronically delivered products such as:

~ Done-for-you websites
~ Funnels and landing pages
~ Testimonial pages
~ Promotional offer pages
~ Global updates
~ Digital design work
~ Configuration and DNS setup
~ Embeddable codes (installation only)
~ Templates
~ System structure and layout

Once delivered, these goods cannot be returned, revoked, or undone, and thus are non-refundable.

Digital Goods are owned by XtremeGrow / The Mustard Seed Group, LLC.
Users receive a license to access them via hosting — not ownership.

2. SaaS Definition (HelloVid)

SaaS (Software-as-a-Service) refers to the HelloVid video widget platform, which provides:

~ Video spokesperson widget
~ Testimonial collection tool
~ Call-to-action buttons
~ Lead forwarding to Google Sheets or CRMs
~ Multi-language support
~ Video hosting
~ Unlimited page views (per HelloVid terms)

HelloVid is an independent subscription-based service, billed separately from XtremeGrow.

XtremeGrow does not manage, access, or bill for HelloVid accounts.

3. Separate Services & Boundaries

It is essential to understand the separation:

✔️ XtremeGrow Provides:

~ Done-for-you website build
~ Website hosting
~ Templates and pages
~ Global updates
~ Domain connection
~ DNS configuration
~ Translation widget installation
~ Support via email
~ Ongoing improvements to the system

✔️ HelloVid Provides:

~ SaaS widget
~ Video recording/hosting
~ Dashboard access
~ Widget customization
~ Testimonial collection tools
~ Multi-video support

Each service has its own billing, policies, and cancellation procedures.

4. Non-Refundable Digital Goods (XtremeGrow)

Due to the nature of our services, the following are non-refundable:

~ Setup fees
~ Digital build-out work
~ Website delivery
~ Customization
~ DNS configuration
~ Global updates
~ Time spent building or adjusting the site
~ Hosting fees already processed
~ Domain registration
~ Digital assets (templates, structure, layout)

Once the site is delivered, labor and intellectual property have been provided, making refunds impossible.

5. Non-Refundable SaaS Charges (HelloVid)

HelloVid fees are not managed, billed, or refunded by XtremeGrow.

Users must contact HelloVid directly for:

~ Billing questions
~ Refund requests
~ Subscription issues
~ Feature concerns

All HelloVid payments are governed by HelloVid’s Terms & Conditions, not XtremeGrow’s.

XtremeGrow cannot:

~ Cancel your HelloVid subscription
~ Access your HelloVid billing
~ Issue refunds
~ Modify HelloVid features

6. Delivery of Digital Goods

Digital Goods are considered delivered when:

~ Your website is built
~ Your DNS is connected
~ Your domain is installed
~ Your site is live or ready to go live
~ Your embed codes are installed
~ You receive your QuickStart access
~ You receive your onboarding instructions

After delivery, the product has been fulfilled in full.

No physical items are shipped.

7. SaaS Access Requirements

To use HelloVid SaaS, you must:

~ Maintain an active HelloVid subscription
~ Comply with HelloVid policies
~ Keep billing information updated
~ Avoid violating usage rules
~ Cancel through their dashboard when needed

If your HelloVid account lapses:

~ Your widget stops functioning
~ Video playback may stop
~ Lead forwarding ceases

This does not impact your XtremeGrow website hosting.

8. Service Dependencies & Limitations

XtremeGrow integrates third-party tools but does not control them.

This includes:

~ HelloVid
~ Translation widgets
~ StatCounter (optional install)
~ Cloudflare DNS
~ AI tools (HeyGen, Creatify, Argil)

XtremeGrow is not responsible for:

~ Third-party outages
~ Third-party billing errors
~ Degraded performance
~ Policy changes by third-party providers
~ Feature modifications
~ Remove/restricted services

All third-party warranties and support follow each provider’s terms.

9. Required Billing Transparency & Auto-Renewal Compliance

XtremeGrow follows:

~ FTC digital service guidelines
~ Subscription transparency laws
~ Clear cancellation access
~ “Click-to-cancel” rules
~ No forced retention tactics
~ No hidden messaging
~ Notice before annual renewals

HelloVid manages its own compliance for SaaS billing.

10. User Responsibilities

Users agree to:

~ Provide accurate information
~ Maintain compliance with their promoted companies
~ Use the digital goods legally
~ Avoid copying, cloning, or redistributing system assets
~ Use the SaaS legally and within fair-use guidelines
~ Cancel subscriptions properly
~ Use the system ethically

Any misuse may result in terminated access or legal action.

11. Restrictions on Use

Users may NOT:

~ Resell the templates
~ Duplicate the structure
~ Reverse-engineer the design
~ Build derivative SaaS systems
~ Offer the system to others
~ Transfer or sell their license
~ Claim ownership over system IP
~ Download or scrape proprietary layouts

Violations result in immediate license termination.

12. Limitation of Liability

XtremeGrow is not liable for:

~ Loss of business
~ Missed commissions
~ Data loss
~ Errors from third-party SaaS tools
~ Website downtime
~ Domain expiration
~ Lead flow interruption
~ Translation inaccuracies
~ Performance outcomes

Digital services are provided on an “as-is” basis.

Users assume full responsibility for results.
